The world can feel better about itself today, the government has decided it has more important issues than how low someone’s pants are hanging. In New Mexico, prosecutors have decided not to file charges against the University of New Mexico football player arrested for wearing saggy pants on a plane at San Francisco airport.
Steve Wagstaffe, the San Mateo County District Attorney, announced Wednesday that after reviewing the case, the June 15 arrest of Deshon Marman do not warrant any criminal charges.
Saggy pants wearers everywhere are rejoicing. First Amendment lawyers aren’t sure if they should be happy or sad.
Okay, so the case wasn’t strictly a free speech case. Marman was originally arrested on suspicion of trespassing, battery of a police officer and obstruction of justice after police say he refused to leave the US Airways flight.
Granted, they did ask him to leave because he refused to pull up his pants. The airline claims he was exposing a body part.
Marman’s attorney, being a quick-witted-gent, has denied his client’s skin was showing and turned the tables on the airline and accused the airline of racial discrimination.
